In California, Is it normal that my ex’s lawyer called me wanting to “resolve this issue” and wants to set a time for me to call her to chat about it?

I filed a restraining order against my ex in California because he sent me multiple text saying he is going to come over to kill me. This violates penal code 422.

I made a police report and he has been served the temporary restraining order. He officially did follow court order and turned in his gun being stored with a gun dealer.

He did not show to 1st court hear because his lawyer filed something to have more time.

I also am supposed to send my evidence to his lawyer and file the evidence too within one week now. The temporary restraining order is still in effect.

What would his lawyer try to say to “resolve” this case outside of court?

Will they try to bribe me in some way? What should ai be aware of to know what is legal?

My ex’s lawyer knows I don’t have an attorney and want me to send them a text to give a time to “chat about this”.

I have a feeling, based on how I know this ex, that he wants me to accept some kind of deal because of course he does not want a restraining order on his record.

Is this normal for his lawyer to contact me and want to resolve this out of court?

IAAL.

I will often call un represented persons to discuss resolving the case. Often this means meetings because my day is heavily booked out.

Where I practice (and I expect in California as well) lawyers have a duty to act with particular care when dealing with unrepresented persons. Does this mean all lawyers do this? No. But the reputable ones will be careful and direct with you.

That being said, his lawyer can’t give you advice. He/She can’t tell you wether the deal is a good one or a bad one. He’s going to give you an offer that benefits his client. It might also benefit you - but he/she won’t be able to tell you that.

You can have the conversation and then take it to a consult with another lawyer and see what they say. Or, you can hire someone to have that conversation for you.

It's not complicated. Most states require you to graduate from a law school accredited by the ABA before sitting for the bar. Here in CA we allow anyone to open up a pretend law school and allow people graduating from Dr Nick's Hollywood Upstairs Law School to sit for the bar; unsurprisingly they do poorly and skew the average down.

If you just count exam-takers who went to real law schools the numbers are close to the same as any other state's.

This is a pretty silly situation until you realize that thousands of totally unqualified people every year get scammed into taking hundreds of thousands of dollars of debt just to sit for an exam that they will almost certainly not pass.

OK - not exactly doing away with the bar exam, but providing an out. I realize there are pros to nixing the bar exam (i.e., not a good indicator of ability, intelligence, persuasiveness, productivity, rainmaking), blah blah blah, but the loophole of Generative AI alone gives me pause on this one... How can someone detect fraud while sifting through 1000 hours of work product?

Tell us what you think about a portfolio bar exam as an alternative pathway to licensure

At the direction of the Board of Trustees, the State Bar is gathering comments on a proposal for a portfolio bar exam (PBE). A candidate who chooses the PBE path to licensure would obtain a provisional license and work under supervision of a licensed California lawyer for four to six months upon graduation from law school. The candidate would assemble a PBE, comprised of a portfolio of work to be assessed by trained independent graders who would determine if the portfolio demonstrated minimum competency to practice law. Candidates whose portfolios achieved passing scores would not need to take the traditional bar exam but would have to fulfill all other requirements for admission. The proposal and public comments will be reviewed by the Board; assuming they approve the proposal, it would then go to the California Supreme Court for their review. Read more and comment here. How to go about getting a good lawyer in CA?

I’m in California and need the advice of a lawyer to see if I’m eligible to get a class B license 5 years after my last conviction and to know how to express expunged convictions on background packets for job applications. What’s the best way to go about getting a lawyer and knowing that they’re a good lawyer? Thanks!

Word of mouth is probably the best way to know they are good. Otherwise you can call your local bar Association’s lawyer referral service to get matched with one, and you should google that lawyer to see if there are reviews.

California - how can I find a lawyer to review a contract?

I really want a lawyer to review a very dense contract from my employer that is relevant to the stock package I receive when I quit. It’s so dense - I’m trying my best but I just can’t understand it.

I want to quit soon so I need to get this done quickly.

I have never worked with a lawyer before and honestly don’t know where to start. Most of my family/ friends with connections are out of state and I think California has specific employment law so I should find someone here?

I tried the legal match online thing but haven’t heard back from any of the lawyers I called.

What should I do? Any advice?

Yeah - as a follow up to this I tried the referral services but the ones in San Mateo county were not a good experience. Honestly I ended up just calling numbers from Google maps and found a great guy! He said the contract was horrible and helped me with the language to push my employer in the right direction. I ended up successfully executing my options! It was only around $900 for the entire thing, which included like 6 bilingual contracts. I now refer this guy to all my colleagues.
